These terms are an agreement between you and Freecomms LLC (“Freecomms”, “we”, “us”) for the Subspace app and the websites weusesubspace.com and app.weusesubspace.com (together, “Subspace”). By installing or using Subspace you agree to them. If you do not agree, do not use Subspace.
1What Subspace is
Subspace lets phones near each other send messages over Bluetooth and WiFi, with an optional internet relay, and lets people create meeting polls. There are no accounts. Subspace is free. We may add, change, or remove features at any time.
2Who may use it
You must be at least 13 years old to use Subspace. If you are under 18, a parent or guardian must agree to these terms for you. Parents who turn on the Parental lock are responsible for using it only on a phone that belongs to their own child or ward and in line with the law where they live.
3Your messages and your responsibility
You own what you write. Because Subspace has no accounts, we usually cannot see who sent a message, and we do not moderate messages that travel phone to phone.
You are responsible for everything you send through Subspace. You agree not to use Subspace to:
- harass, threaten, bully, or stalk anyone;
- send content that is illegal, hateful, sexual involving minors, or that encourages violence or self harm;
- impersonate another person, or claim a display name in order to mislead people;
- spam, flood, or deliberately overload the mesh or the relay;
- send malware, or share a copy of the app that has been altered;
- interfere with how other people use Subspace, or try to break into, reverse engineer, or disrupt our servers;
- break any law, including laws about electronic communications and monitoring in the place you are using the app.
If you receive something that violates these rules, you can leave the channel, ignore the sender, and, if it is serious, report it to local authorities. You can also tell us at hello@weusesubspace.com.
4Open broadcasts are public
Messages in #open-air and in public channels are broadcast in the open to any Subspace phone within range, and, with Mobile data on, through our relay. Anyone nearby running Subspace can read them. Do not post anything there that you would not say out loud in a room full of strangers. Private chats, group chats, and password protected channels are encrypted, but the people you share them with can still copy or screenshot what you send.
5The relay (Mobile data)
The relay is a convenience we provide so messages can travel over the internet. It is off by default. We may rate limit, suspend, or shut down the relay at any time, including to stop abuse. Relay messages are kept for 24 hours and then deleted. A display name on the relay is reserved for the first phone that claims it and is released after 7 days without use; we do not guarantee that any name stays yours.
6Parental lock
The Parental lock lets a parent or guardian limit parts of the app on the phone of their own child and receive activity reports by email. By turning it on you confirm that you have the legal right to supervise that phone and that person. Reports are sent to the email address you enter; keep that address secure. The lock cannot prevent the app from being uninstalled, and the “stopped checking in” alert is our best effort, not a guarantee. We are not responsible for what a report does or does not catch.
7Meeting polls
Polls created with “Schedule a Meetup” are hosted on app.weusesubspace.com. The organizer link lets anyone who has it edit or delete the poll, so share it carefully. Do not put private information in a poll title or answer. We may remove polls that break these terms or that are abandoned.
8Sharing the app
You may share an unmodified copy of the Subspace app file with another phone using the “Share Subspace” feature. You may not change the app, re-sign it, charge for it, or distribute it under another name.
9Our rights in Subspace
Subspace, its code, its name, and its logo belong to Freecomms LLC. We give you a personal, free, non-exclusive license to install and use the app on devices you own or control. You may not copy, modify, sell, or reverse engineer the app except where the law allows it regardless of these terms.
10Privacy
Our Privacy Policy (weusesubspace.com/privacy) explains what information Subspace handles and is part of these terms.
11The service is provided “as is”
This section exists for legal reasons and applies as far as the law allows.
Subspace is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that Subspace will be available, secure, error free, or that messages will be delivered. Radio range, interference, phone settings, and other people’s devices are all outside our control.
Subspace is not a replacement for emergency services. It cannot call 911 or any emergency number. Do not rely on it in an emergency.
12Limitation of liability
To the fullest extent the law allows, Freecomms LLC and its members, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to Subspace, even if we were told such damages were possible. Our total liability for any claim related to Subspace is limited to the greater of the amount you paid us for Subspace (which is zero) and one hundred US dollars (US $100). Some places do not allow these limits, so some of them may not apply to you.
13Your promise to us (indemnity)
If someone makes a claim against us because of something you sent or did with Subspace in breach of these terms or the law, you agree to cover the costs, including reasonable legal fees, that we incur because of it.
14Ending things
You can stop using Subspace at any time; uninstalling it or using “Optimize” removes your data from the phone. We may block a device, a display name, or a key from the relay, or stop providing Subspace altogether, at any time, with or without notice, especially if these terms are broken. Sections 9 through 16 survive the end of these terms.
15Changes to these terms
We may update these terms. We will change the date at the top and, for important changes, show a notice in the app or on the website. Using Subspace after a change means you accept the new terms.
16Law and disputes
These terms are governed by the laws of the State of Indiana, United States, without regard to its conflict of law rules. Any dispute that cannot be settled informally will be brought in the state or federal courts located in Allen County, Indiana, and you agree to that location. Before filing anything, please email us at hello@weusesubspace.com; most problems can be fixed with a conversation.
17Other things lawyers expect
If any part of these terms is found unenforceable, the rest still applies. If we do not enforce a term right away, we can still enforce it later. These terms are the whole agreement between you and us about Subspace. You may not transfer your rights under these terms; we may transfer ours to a company that takes over Subspace.
